TERMS OF SERVICE
The purpose of these general conditions of use (hereinafter "GTU") is to set the conditions of use of the services (hereinafter referred to as "the Services") offered on the website accessible at the URL address https: //www.la-methode-gun.fr (hereinafter "the Site") and mobile and tablet applications (hereinafter "the Applications").
Any person having access to the Sites, Applications, whatever their capacity (individual or professional), the place where they are, the methods of connection to the Site and the Applications, the object and the purpose of their access to the Site and the Applications and/or use of the Services, is a user (hereinafter "the User").

TERMS OF SALES
1. Identification of the seller

2. Scope and acceptance of the general conditions of sale

M******** products are exclusively intended for sale to end consumers who are natural or legal persons, excluding any resellers or intermediaries acting on behalf of resellers. 3. Terms of Order
The Site makes it possible to order from the company M ******** a selection of products, in particular of the GUN brand (hereinafter the “Product(s)”), immediately online via the Internet for delivery to metropolitan France. These General Terms and Conditions of Sale therefore do not apply to special orders. For any special order, please contact our Customer Service by clicking on the "Contact" link.
4. Product Availability
Our Product offers and prices are valid as long as they are visible on the Site, within the limits of available stocks. Errors or modifications may exceptionally exist, in particular in the case of simultaneous orders for the same Product by several customers. In the event of unavailability of a Product after placing your order, we will inform you of this by e-mail or telephone as soon as possible, offering you either to order another Product presented on the Site as a replacement, or to cancel your order.
M ******** does not incur any liability in the event of out of stock or unavailability of Products for orders not yet accepted by M ********.
M ******** reserves the right to change the Products offered on the Site at any time and without notice. 5. Order procedure
5.1. Product Selection

You can consult your selection by clicking on the basket in the ad hoc menu where will appear: the photo(s) of the Product(s), its name(s), its characteristics, the ) quantity(ies) chosen, its (their) unit price(s), the sub-total of the selection, the delivery costs for metropolitan France as well as the total price of your order including delivery.

If you don't have an account yet, you can continue shopping as a guest by entering your email address.
Your usernames and passwords are strictly personal, therefore you agree to keep them safe and never communicate them to third parties. MG ******** can in no way be held responsible for any loss, theft or any fraudulent use of your customer account, if necessary you agree to inform MG ******** immediately .
Creating an account allows you to:
- track your deliveries and view your order history;
- add or modify your delivery and billing addresses for your next orders;
The data recorded by the Site constitutes proof of all transactions between M ******** and its customers. In case of conflict between M ******** and one of its customers on a transaction carried out on the Site, the data recorded by M ******** are considered as valid proof of the content of the transaction.
You can deactivate your account at any time by sending an e-mail to Customer Service by clicking on the "Contact" link. After deactivating your account, you are free to create a new account at any time.
5.3. Confirmation of the order
5.3.a) Validation of the delivery method
You will need to complete the delivery information necessary for the proper dispatch of your order: country of dispatch, title, first name, surname, telephone, delivery address.
You can use your delivery address as the billing address or enter another one. You will then be prompted to select a payment method and enter the relevant information.
Once this step is complete, click on “validate”.
5.3.b) Validation of the means of payment and payment of the order
At the end of the ordering process described above and after having accepted all of these General Conditions of Sale and Use and the Return/Refund Policy, click on the "pay your purchases" button. The sales contract will then be definitively formed.
You must carefully check the accuracy of your selection before confirming your order. MG******** reserves the right not to accept an order from a customer with whom it is in dispute for a previous order, or if MG******** reasonably believes that such customer has breached these Terms and Conditions or engaged in fraudulent activity, or for any other legitimate reason.
5.3.c) Confirmation of the order
A summary of your order will then be sent to you by e-mail. The acknowledgment of receipt will include the total amount of the order, information relating to the cost of delivery, the essential characteristics, the quantity and the price of the Products purchased.
We advise you to keep this acknowledgment of receipt on paper or electronically.
6. Price – Means of Payment accepted
The prices of the Products are indicated in Euros, all taxes included. Apart from the cases of reimbursement made (i) within the framework of the exercise of the right of withdrawal or for (ii) lack of conformity and hidden defects, MG ******** will not reimburse the VAT applied to the purchases made on the Site (even in the event that the buyer, after receipt, returns the Products to a country outside the European Union).
MG ******** reserves the right to modify at any time and without notice the prices of the Products offered on the Site. The Products are invoiced on the basis of the prices displayed on the Site at the time of placing your order, subject to the availability of the Products ordered at that time.
All orders are payable in Euros and must be paid immediately when placing your order. In the event of the unavailability of certain Products ordered (see Article 4 “Availability of Products”), only the price and transport costs relating to the available Products will be debited.
It is possible that you will be asked to pay customs fees on your order when your package arrives if you are ordering outside the European Union.
These costs will be payable by the Customer.
6.2. Means of payment accepted
6.2.a) Payment by credit card or bank card
The credit cards and bank cards accepted are: Visa®, MasterCard® and Amex®.
Authentication is specific to each bank.
The dispatch of your order takes place only after verification of your method of payment and receipt of the authorization to debit your card.
7. Retention of Title
The Products ordered remain the property of MG ******** until full payment has been received by MG ********.
On the other hand, you assume the risks (in particular of loss, theft or deterioration) concerning the Products delivered from the moment they are sent to the address indicated during the order.
8. Terms of delivery
8.1. Delivery and pick-up area
8.1.a) Delivery to a postal address
Products purchased on the site are delivered by post (Standard Home mode):
- In Europe: France (including Corsica), Belgium, Guadeloupe, Martinique, Mayotte, Reunion, Saint-Martin, Luxembourg, Monaco
- In the world
The Products are shipped to the delivery address that you indicated during the ordering process. To validate your order, you are asked to enter a valid telephone number.
8.2. Transportation costs
The amount of the delivery costs is calculated according to the Products chosen, the total value of your order and the delivery method chosen.
9. Delivery issues
Any defect or delay in delivery must be reported to our Customer Service as soon as possible. Any complaint made more than 14 calendar days after the date of receipt of your order cannot be taken into account.
In case of non-compliance with the delivery time, you can cancel the order, simply by e-mail or registered letter to the following address:

MG ******** will then be required to reimburse you for all sums paid, at the latest within fourteen (14) days following the date of termination of the sales contract. If you nevertheless receive the Product after having used this option, you must return it according to the return procedures provided for in article 10 below.
You must check the conformity of the Products at the time of delivery and indicate, if possible on the delivery note, in the form of handwritten reservations accompanied by your signature, any anomalies observed (open package, damaged Product, etc.).
10. Right of withdrawal – returns, exchanges, refunds
10.1. Right and period of withdrawal
We accept the return of any product within 14 days from the date of dispatch on the condition that it is intact and in a condition to be potentially resold (without restocking costs). You will receive, at your choice, a credit on our site or a refund.
After this period, you will no longer be able to exercise your right of withdrawal.
10.2. Modalities for exercising the right of withdrawal
You can, before the expiry of the withdrawal period of 14 days mentioned above, send any other unambiguous declaration expressing your wish to withdraw to the following address:

or through the "Contact" section of our site. You will be asked for your first and last name and your order number. Once your request has been received by e-mail, our after-sales service will send you a return label by e-mail. Print it, and use it to ship the return package.
Once your package has been received by our services, if everything is in order, we will refund the item.
The return shipping costs will be deducted from the total refund of your order if the product is not declared and verified as defective, therefore solely due to the customer.
We do not exchange items. If you want another size, you will have to reorder on la-methode-gun.fr.
10.3. Consequence of the right of withdrawal
As part of the exercise of the right of withdrawal or in the event of non-compliance of the Product, you can return the Product(s) purchased by requesting an exchange or a refund under the conditions described in l 11 below.
11. Terms of return, exchange, and refund
As part of exercising the right of withdrawal and to be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.
- Gift cards
To complete your return, we require a receipt or proof of purchase.
Please do not return your purchase to the manufacturer.

In the event of a request for reimbursement, the latter will take place, in accordance with the legislation, fourteen (14) days from either (i) receipt of proof of shipment of the Product(s), or (ii) the receipt of the Product(s), the date chosen being that of the first of these events. The refund, including the standard delivery costs of the initial order, will then be made using the same method of payment used when ordering.
Please note, however, that an additional delay may be applied by your bank when refunding.
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
12. Limitation of Liability
Under no circumstances can MG ******** be held liable for any damage that does not result from a breach by MG ******** of one of its obligations.
13. Applicable law - Disputes
These General Conditions of Sale are governed and interpreted in accordance with French law. However, in accordance with EC Regulation 593/2008 of June 17, 2008, these General Terms and Conditions of Sale do not prevent MG ******** from complying with a provision that is more favorable to the customer and to which he cannot be waived by agreement, under the law where the customer has his habitual residence.
In the event of a dispute related to the execution of an order, you have the possibility of resorting to a conventional mediation procedure or to any other procedure for alternative dispute resolution.
These General Conditions of Sale are written in French. Notwithstanding the foregoing, in the event of a dispute, in accordance with Regulation No. 44/2001 of December 22, 2000:
